Rise Plus Membership — Terms & Conditions

Welcome to Rise Plus, the official membership program from Rise Gardens, Inc. ("Rise Gardens," "we," "us," or "our"). These terms supplement and form a part of the Rise Gardens Terms of Service. By purchasing or activating a Rise Plus Membership ("Membership"), you ("Member," "you," or "your") agree to the following terms and conditions. Please read them carefully before enrolling.

1. Overview & Definitions

  • Rise Plus Membership — A paid subscription program that provides Members with quarterly Seed Credits and additional benefits for their Rise Garden or Personal Garden.
  • Seed Credit — A digital credit issued quarterly to Members that can be redeemed for eligible products in the Rise Gardens online store.
  • Member — Any individual who has purchased and activated a Rise Plus Membership plan.
  • Billing Period — The full duration of a Membership plan (1 year or 2 years from the membership start date).
  • Quarter — A three-month period beginning from your Membership start date. Each Billing Period contains four quarters (1-Year plan) or eight quarters (2-Year plan).

2. Membership Plans & Pricing

Rise Plus is available in two garden tiers, each with a 1-Year and 2-Year option:

Personal Garden — 1 Year: $199 — 4 Seed Credits per quarter
Personal Garden — 2 Years: $329 — 4 Seed Credits per quarter
Rise Garden — 1 Year: $299 — 6 Seed Credits per quarter
Rise Garden — 2 Years: $499 — 6 Seed Credits per quarter

2.1 Payment

The full Membership fee is charged at the time of purchase. All prices are in U.S. dollars (USD). Applicable taxes will be added based on your shipping address.

2.2 Auto-Renewal

Memberships automatically renew at the end of each Billing Period at the then-current price unless you cancel before the renewal date. We will notify you by email no less than 30 days and no more than 60 days prior to renewal. You may cancel auto-renewal at any time through your account settings at risegardens.com. You may also cancel by emailing support@risegardens.com.

2.3 Confirmation & Acknowledgment

Upon enrollment, Rise Gardens will send you a confirmation email that includes your plan details, auto-renewal terms, cancellation policy, and instructions for how to cancel. This confirmation serves as your acknowledgment of the automatic renewal terms of your Membership.

3. Seed Credit Program

3.1 Credit Allocation

  • Personal Garden plans: 4 Seed Credits per quarter (16 total for 1-Year, 32 total for 2-Year).
  • Rise Garden plans: 6 Seed Credits per quarter (24 total for 1-Year, 48 total for 2-Year).

3.2 Redemption

Each Seed Credit can be redeemed for one of the following eligible products:

  • One seed pod 4-pack

Credits are applied at checkout on risegardens.com. Only eligible products qualify for Seed Credit redemption. Rise Gardens reserves the right to update the list of eligible products at any time.

3.3 Credit Issuance Schedule

Seed Credits are issued quarterly, beginning on your Membership start date. Credits for each quarter are deposited into your account on the first day of each new quarter throughout your Billing Period.

3.4 Credit Rollover 

Unused Seed Credits expire at the end of the following quarter and only roll over for a single quarter. You must redeem your credits within that quarter in which they are issued. Rise Gardens will make reasonable efforts to remind Members of upcoming Seed Credit expiration via email. Rise Gardens is not responsible for unredeemed credits.

3.5 Additional Restrictions

  • Seed Credits have no cash value and cannot be exchanged for cash or store credit.
  • Seed Credits are non-transferable and may only be used by the account holder.
  • Seed Credits are non-refundable.
  • Credit redemption is subject to product availability. If a desired product is out of stock, credits cannot be reserved or extended beyond the current quarter.

4. Member Benefits

In addition to Seed Credits, all Rise Plus Members receive the following benefits for the duration of their active Membership:

  • Free shipping on all orders of $50 or more (contiguous U.S. only).
  • 15% discount on nutrients and accessories purchased through risegardens.com.
  • 3x Rise Rewards points earned on every purchase (points are subject to the Rise Rewards program terms).
  • Member-exclusive seed drops — access to limited-edition and seasonal seed varieties before they are available to the general public.

4.1 Additional 2-Year Plan Benefits

Members enrolled in a 2-Year plan also receive:

  • Early access to new products — preview and purchase new Rise Gardens products before public launch.

4.2 Benefit Limitations

  • Member discounts cannot be combined with other promotional offers, coupons, or sale pricing unless expressly stated.
  • Free shipping applies only to standard shipping within the contiguous United States.
  • Rise Gardens reserves the right to modify, suspend, or discontinue any benefit with 30 days' prior notice to Members.

5. Cancellation & Refund Policy

5.1 Cancellation

You may cancel your Membership at any time. To cancel, visit your account settings at risegardens.com. You may also cancel by emailing support@risegardens.com.

  • Cancellation takes effect at the end of the current Billing Period. You will continue to receive Seed Credits and Member benefits until that date.
  • No partial refunds will be issued for any remaining time in the current Billing Period.
  • Cancellation of auto-renewal may be done at any time and prevents charges for the next Billing Period.

5.2 Refunds

  • No partial refunds will be issued for any remaining time in the current Billing Period.
  • All unused Seed Credits are forfeited at the end of the term even if cancelled and will not be refunded or converted to store credit.

5.3 Effect of Cancellation

Upon cancellation:

  • All Membership benefits (discounts, free shipping, bonus Rewards points, exclusive access) end immediately when the current Billing Period expires.
  • Any unused Seed Credits remaining in the current quarter are forfeited.
  • You may re-enroll in a new Membership at any time at the then-current pricing.

5.4 Billing Inquiries

If you believe there is an error on your billing statement related to your Membership, you must contact us within 60 days of the charge in question. Please email support@risegardens.com with your account details and a description of the billing error. We will investigate and respond within 30 days of receiving your inquiry.

6. Account Suspension & Termination

Rise Gardens reserves the right to suspend or terminate your Membership at any time if:

  • Your payment method fails and the issue is not resolved within 14 days of notification.
  • You engage in fraudulent activity, including but not limited to misrepresentation of garden ownership or abuse of the Seed Credit program.
  • You violate these terms or the Rise Gardens Terms of Service.

If your Membership is terminated for cause, you will not be entitled to a refund for any remaining portion of the current Billing Period. Rise Gardens will notify you by email prior to any suspension or termination.

7. Eligibility & Restrictions

  • Rise Plus Membership is available to individuals who own a Rise Garden or Personal Garden product.
  • You must have a valid Rise Gardens account with a verified email address.
  • Memberships are available for shipping addresses within the contiguous United States only. Hawaii, Alaska, Puerto Rico, U.S. territories, and international addresses are not eligible.
  • Only one active Membership is permitted per garden. You may not stack multiple memberships on a single garden.
  • You must be at least 18 years of age to purchase a Membership.
  • Rise Gardens reserves the right to verify garden ownership and cancel Memberships obtained fraudulently.

8. Modifications to the Program

Rise Gardens reserves the right to modify, update, or discontinue any aspect of the Rise Plus Membership program, including pricing, benefits, Seed Credit allocation, and eligible products, at any time. We will provide Members with at least 30 days' written notice (via email) before any material changes take effect. For material changes to pricing, we will obtain your affirmative consent or provide you with the option to cancel within 14 days of notification for a pro-rated refund. Continued use of your Membership after the effective date of non-pricing changes constitutes acceptance of the updated terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Rise Gardens shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your Membership, including but not limited to loss of Seed Credits, inability to redeem credits due to product unavailability, or interruption of Member benefits. Our total liability to you for any claim related to the Membership shall not exceed the amount you paid for the current Billing Period.

10. General Provisions

10.1 Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

10.2 Entire Agreement

These terms, together with the Rise Gardens Terms of Service and Privacy Policy, constitute the entire agreement between you and Rise Gardens regarding your Membership.

10.3 Force Majeure

Rise Gardens shall not be liable for delays or failures in providing Seed Credits, Member benefits, or other obligations under these terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, pandemics, or government actions.

10.4 Privacy

Personal information collected in connection with your Membership is governed by the Rise Gardens Privacy Policy.

11. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-law principles. To the extent permitted by applicable law, any disputes arising from or related to these terms shall be resolved through binding arbitration in Chicago, Illinois, in accordance with the rules of the American Arbitration Association. To the extent permitted by applicable law, you agree to waive any right to a jury trial or to participate in a class action.

Legacy Membership Terms (Pre–March 2026)

The following terms apply to Rise Gardens memberships purchased before March 15, 2026, under the original seasonal box program. If you enrolled before this date and have not transitioned to Rise Plus, these terms continue to govern your membership. The legacy "seasonal box" program is distinct from the Rise Plus "Seed Credit" program — differences in benefits (including the $30 free shipping threshold vs. $50 for Rise Plus) are intentional per each program's terms.

Membership Terms and Conditions

By purchasing a Rise Gardens Membership, you agree to the following terms and conditions, which supplement and form a part of the Rise Gardens Terms of Service. Capitalized terms not defined here have the meaning given to them in the Rise Gardens Terms of Service.

Membership Scope

Membership is not available to Alaska, Hawaii, Puerto Rico, Armed forces, U.S virgin Islands, Northern Mariana Islands, Marshal Islands, Guam, Micronesia, American Samoa territories

The Rise Gardens membership provides you with many unique benefits. For the most up-to-date list, click here. Membership benefits include, but are not limited to:

  • 15% discount applies to seeds, nutrients, accessories, and replacement parts. The discount does not include gardens or extensions. This discount is not reflected in the seasonal box items as those products are included in the cost of the membership.
  • A seasonal box that includes 4, 6 or 9 products depending on the offer purchased. This box is delivered every 91 days and you have the option to update the box for every order with your choice of seeds.
  • Free shipping! Free shipping applies to any order over $30 and on all seasonal boxes for all US territory except for: Alaska, Hawaii, Puerto Rico, Armed forces, U.S virgin Islands, Northern Mariana Islands, Marshal Islands, Guam, Micronesia, American Samoa. The free shipping applies to seeds, nutrients, accessories and replacement parts. Free shipping on initial purchase is a promotional offer on gardens and extensions and is not included as part of the membership program and can be modified at our discretion.
  • Loyalty point multiplier. Loyalty points are automatically multiplied for purchases and app actions made by you. Loyalty points are applied on every purchase except for the initial garden purchase.
  • Special access to sales, promotions, and new products. Unless specified otherwise discounts will not stack with the membership discount.

Rise Gardens may adjust the terms above without justification or notice.

Rise Gardens plant scientists take great care in selecting plants with high germination and success rates, but just like in nature, some of your plants may not germinate or reach harvest-age maturity. We guarantee a 100% germination guarantee on our seeds. For our full replacement policy on seeds click here. The portfolio of plants presented on the Rise Gardens website and application is indicative and can be changed by Rise Gardens at its sole discretion and with no prior notice. No refund of the membership can be claimed as a result of a change in the portfolio of seed pods offered by Rise Gardens.

Membership Coverage and Billing Cycles

Membership Coverage

By purchasing a Membership in connection with your purchase of a Rise Gardens (a "Device Membership") you will get full and unlimited access to all membership benefits for as long as the Device Membership remains active. The account holder of the Device Membership is the person who activated the Membership on the device(s) or in the app to which the Membership is attached (the "Membership Holder"). As a Membership Holder you may possess one or more Memberships depending on the number of devices you own.

Billing Cycles and Auto-Renewal

You may select either a seasonal (91 days) a 1-year or 2-year Rise Gardens Membership term. You will be charged immediately for the initial term. Following the initial term, your Rise Gardens Membership will automatically renew for a term of the same duration as the initial term (i.e. monthly, one-year, two-year respectively), unless action is taken to select a different term or cancel the current one before it renews. We will charge any credit or debit card we have on file for you at the fee then in effect plus any applicable taxes on a recurring basis without further notices to you (except to the extent that notice is required by applicable law) unless and until you notify Rise Gardens of your desire to cancel your Rise Gardens Membership by following the Rise Gardens Membership cancellation process. To avoid being charged for a new term, you must cancel your membership subscription before the end of the current term. If you cancel, you can continue to access Rise Gardens Membership benefits until the end of your term.

Prepaid Periods

You may be given the opportunity to prepay for a period of one or more months of your Membership. At the conclusion of a prepaid period, unless you cancel prior to renewal, and to the extent permitted by applicable law, your Membership will automatically continue for a term of the same duration as the initial term (i.e. monthly, 1-year, 2-year respectively) at the then-existing non-promotional price for your Membership level.

Offers

Rise Gardens may offer some promotions or discounts related to Memberships from time to time. Please read the details of those offers carefully, as any additional terms presented to you during the sign-up process will form part of these Membership Terms. Unless specified in writing, all discount offers that require a payment are non-refundable. Any free trial or other promotion must be used within the specified time frame of the trial or promotion. You may be required to have a valid payment method on file in order to initiate a free trial; in this case, if you do not cancel before your free trial period ends, your account will be converted to a paid Membership and will be charged in accordance with these Membership Terms.

Coupon codes are not stackable if with membership promotions.

Account Registration

You can register by successfully completing a Rise Gardens purchase, or by creating an account on the Rise Gardens website or Rise Gardens app, as further described in our Terms of Service. All information that you provide must be accurate, including your name, address, credit, debit or charge card numbers and expiration dates, and any other payment information. You are responsible for keeping such information up-to-date and must provide changes promptly to your account page, which may be accessed through the settings page of the Rise Gardens App. Rise Gardens use of your information is governed by our Privacy Policy. YOU MUST PROMPTLY NOTIFY US OR OUR PAYMENT PROCESSORS IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USERNAME OR PASSWORD.

Termination, Pausing, or Cancellation of Membership

To ensure you receive all seasonal boxes and retain your membership benefits, please cancel your annual membership only after you have received all scheduled seasonal boxes and before your renewal date. Cancelling your membership outside of this timeframe will result in the cancellation of any remaining seasonal box subscriptions and the loss of your membership benefits.

If you pause or terminate your Membership before the end of the then-current period you won't be eligible for a prorated refund of any portion of the Membership fee paid for the then-current Membership period, subject to specific cancellation and refund rights listed below for certain Canadian residents. All membership plans are eligible for cancellation.

Suspension/Termination by Rise Gardens

Rise Gardens may immediately terminate or suspend your account, and all or a portion of your Membership, without notice if: (a) your payment is overdue (provided that we will use reasonable efforts to notify you of the overdue payment before we terminate or suspend); (b) you provide false or inaccurate information; (c) you violate these Membership Terms, the Terms of Service, or any other Rise Gardens rules or agreements then in effect; (d) you engage in conduct that is a violation of any applicable law or tariff (including, without limitation, copyright and intellectual property laws); or (e) if you engage in conduct that is threatening, abusive, or harassing to Rise Gardens employees, agents, or other Rise Gardens users, including, for example, making threats to physically harm or damage property. If we terminate or suspend your Membership, your license to use any software or content provided in connection with the Membership is also terminated or suspended (as applicable). If your Membership is terminated, Rise Gardens has the right to immediately delete all data, files, and other information stored in or for your account without further notice to you. You must pay all charges up to and including the date of termination. Should you wish to resume your Membership after any suspension, a restoration of service fee may apply. This fee is in addition to all past due unpaid charges and other fees.

Payment

Membership Holders agree to pay the monthly fee specified when you purchased your Membership (plus any applicable taxes and other charges). If the amount to be charged varies from the amount you pre-authorized (other than due to the imposition of, or change in, applicable sales tax), you have the right to receive, and we will provide, notice of the amount to be charged and the date of the charge before the scheduled date of the transaction, unless applicable law requires you to expressly consent to the change in price. Any agreement you have with your payment provider governs your use of your specified payment method. You agree that we may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle. Your failure to terminate and/or continued use of your Membership reaffirms that we are authorized to charge you for that Membership. We may submit those charges for payment and you will be responsible for such charges. This does not waive our right to seek payment directly from you.

Billing Authorization

You may be asked to provide a payment method (such as a credit, charge, or debit card number) that we accept in order to activate your Membership, along with other payment information. You represent and warrant that you have the legal right to use all payment method(s) that you provide to us. Your authorizations in this section also apply to our payment processors and any other companies who act as billing agents for us. You hereby authorize us to charge your specified payment method on a monthly basis, in advance, for your Membership(s) and/or to place a hold on your payment method with respect to any unpaid charges for your Membership(s). You authorize the issuer of your selected payment method to pay any amounts described herein without requiring a signed receipt, and you agree that these Membership Terms shall be accepted as authorization to the issuer of the payment method to pay any amounts described herein, without requiring a signed receipt from you. You authorize us to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your payment method until such amounts are paid in full. You agree to provide updated payment information upon request and any time the information you previously provided is no longer valid. You acknowledge and agree that neither Rise Gardens, nor any Rise Gardens agent, will have any liability whatsoever for any insufficient funds or other charges incurred by you as a result of attempts to charge, and/or place holds on, your specified payment method as contemplated by these Membership Terms. If you provide a debit card number instead of a credit card number, you authorize all charges described herein to be applied to such debit card unless and until you provide a credit card number.

Third-Party Payment Processors

You agree to pay us, through our payment processors or financing partners (as applicable), all charges at the prices then in effect for any purchase in accordance with the applicable payment terms presented to you at the time of purchase. You agree to make payment using the payment method you provide when you set up your account. We reserve the right to correct, or to instruct our payment processors or financing partners to correct, any errors or mistakes, even if payment has already been requested or received.

Financed Purchases

If you finance the purchase of your Membership, you agree to abide by the terms of the financing agreement with our financing partner governing your purchase, which will be provided to you separately. Rise Gardens may treat your failure to abide by the terms of your financing agreement with our financing partner as a breach of these Membership Terms.

Bill Inquiries and Refunds

If you believe you have been billed in error for a Membership, please notify us within 60 days of the billing date by contacting Rise Gardens Support at support@risegardens.com. Rise Gardens will not issue refunds after the expiration of this 60-day period, except where required by applicable law.

Statutory Cancellation Rights (Certain Canadian Residents Only)

British Columbia You may cancel your Device Membership 10 days after you initially subscribe for any reason by sending Rise Gardens a notice of cancellation to support@risegardens.com

Ontario Your Rights under the Consumer Protection Act 2002: You may cancel this agreement at any time during the period that ends ten (10) days after the later of the day you receive a written copy of the agreement and the day all the services are available. You do not need to give the supplier a reason for cancelling during this 10-day period. In addition, there are grounds that allow you to cancel this agreement. You may also have other rights, duties and remedies at law. For more information, you may contact the Ministry of Consumer and Business Services. To cancel this agreement, you must give notice of cancellation to the supplier, at the address set out in the agreement, by any means that allows you to prove the date on which you gave notice. If no address is set out in the agreement, use any address of the supplier that is on record with the Government of Ontario or the Government of Canada or is known by you. If you cancel this agreement, the supplier has fifteen (15) days to refund any payment you have made and return to you all goods delivered under a trade-in arrangement (or refund an amount equal to the trade-in allowance).

Saskatchewan Your Rights under The Consumer Protection and Business Practices Act: You may cancel this contract at any time during the period that ends seven (7) days after the later of the day you receive a written copy of the contract and the day all the services are available (in calculating the 7 days, count only days on which the supplier is open for business). You do not need to give Rise Gardens a reason for cancelling during this period. In addition, there are other grounds that allow you to cancel this contract. You may also have other rights, duties and remedies at law. For more information, you may contact the Consumer Protection Division, Financial and Consumer Affairs Authority of Saskatchewan. To cancel this contract, you must give notice of cancellation to Rise Gardens, at 4515 N Ravenswood, Avenue, Chicago, Illinois 60640 by personal service, by registered mail or by any other means set out in the contract. If you cancel this contract, the supplier has fifteen (15) days to refund any payment you have made.
